Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and LEKEELEKEE247 LTD governing your access to and use of LekeeLekee's products, services, mobile applications, and websites (collectively, the "Services"). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Services.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use our Services. If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that you have obtained consent from a parent or legal guardian to use the Services and that they have read and agreed to these Terms on your behalf.

3. Your Account

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Not share your account credentials with any third party
• Immediately notify us of any unauthorized access or security breach
• Accept full responsibility for all activities that occur under your account

3.1 Usernames

We reserve the right to reclaim, reassign, or remove any username at our sole discretion, including but not limited to usernames that:

• Cybersquatting: Are registered with the intent to profit from, impersonate, or prevent the rightful owner from using a name associated with a public figure, brand, trademark, or organization
• Are inactive for an extended period
• Violate trademark rights or intellectual property of others
• Are misleading, offensive, or violate our Acceptable Use Policy
• Are reserved for official accounts, verified entities, or platform purposes

You acknowledge that you have no ownership rights to any username and that LEKEELEKEE247 LTD may take action on usernames without prior notice or compensation.

4. User Content

You retain ownership of the content you post, upload, or share through our Services ("User Content"). However, by posting or sharing User Content, you grant LEKEELEKEE247 LTD a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, use, display, reproduce, modify, adapt, edit, publish, distribute, and create derivative works of such User Content solely for the purposes of operating, developing, providing, promoting, and improving our Services.

You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to grant this license for any User Content you submit.

5. Acceptable Use Policy & Prohibited Content

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct and any User Content you submit. The following activities and content are strictly prohibited:

5.1 Illegal & Harmful Content

• Child Sexual Abuse Material (CSAM): Any content depicting, promoting, or facilitating child exploitation or abuse is strictly prohibited and will be reported to law enforcement authorities
• Pornography & Sexually Explicit Content: Nudity, sexual acts, or sexually explicit material of any kind
• Violence & Gore: Graphic violence, torture, mutilation, or content glorifying violence
• Terrorism & Extremism: Content promoting, supporting, or glorifying terrorist organizations or extremist ideologies
• Illegal Drugs: Content promoting, selling, or facilitating the sale or use of illegal drugs or controlled substances
• Weapons & Firearms: Content promoting, selling, or facilitating the sale of weapons, firearms, explosives, or ammunition
• Human Trafficking: Content promoting or facilitating human trafficking, slavery, or exploitation
• Self-Harm & Suicide: Content promoting, glorifying, or providing instructions for self-harm or suicide

5.2 Harmful Behavior

• Harassment & Bullying: Targeting individuals with abuse, threats, intimidation, or unwanted contact
• Hate Speech: Content attacking individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
• Doxxing: Sharing private or personal information of others without consent
• Impersonation: Falsely representing yourself as another person, brand, or organization
• Fraud & Scams: Deceptive schemes, phishing, or attempts to defraud users
• Misinformation: Deliberately spreading false information that could cause harm

5.3 Platform Abuse

• Spam: Repetitive, unsolicited, or bulk messaging or posting
• Manipulation: Artificially inflating engagement through fake accounts, bots, or coordinated activity
• Malware: Distributing viruses, malware, or harmful code
• Unauthorized Access: Attempting to access accounts, systems, or data without authorization
• Scraping: Automated collection of data without permission
• Circumvention: Bypassing security measures, rate limits, or access restrictions

5.4 Intellectual Property Violations

• Posting content that infringes copyrights, trademarks, or other intellectual property rights
• Using our trademarks, logos, or branding without authorization

Enforcement: We reserve the right to remove any content and suspend or terminate any account that violates this Acceptable Use Policy, at our sole discretion and without prior notice. Serious violations may be reported to law enforcement authorities.

6. Content Moderation

We may, but are not obligated to, monitor, review, or moderate User Content. We reserve the right to remove or disable access to any User Content at any time, for any reason, without notice. We are under no obligation to store, maintain, or provide copies of any User Content.

7. Ideas & Feedback

If you submit ideas, proposals, suggestions, or feedback regarding our Services ("Feedback"), you acknowledge and agree that such Feedback automatically becomes the sole property of LEKEELEKEE247 LTD without any compensation or obligation to you. We shall own all rights, title, and interest in and to such Feedback and may use it for any lawful purpose.

8. Termination

We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of the Acceptable Use Policy
• Conduct that we determine poses a risk to other users, third parties, or our operations
• Request by law enforcement or government agencies
• Discontinuation or modification of the Services

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

9. Advertising

Our Services contain advertisements and sponsored content, which are clearly labelled. By using our Services, you acknowledge and agree that:

• LekeeLekee may display advertisements from third-party advertising networks throughout the platform, including in content feeds, sidebars, and within the mobile application
• Advertisements and sponsored content are provided by third-party advertisers and advertising networks. LekeeLekee does not endorse and is not responsible for the products, services, or claims made in any advertisement
• Clicking on advertisements may redirect you to third-party websites or services that are governed by their own terms of service and privacy policies
• LekeeLekee reserves the right to display, modify, or remove advertisements at any time and at its sole discretion
• Ad-blocking software may interfere with the functionality of our Services

10. LekeeLekee Wallet

The LekeeLekee Wallet ("Wallet") is a stored-value feature that lets you hold a balance for use within the Services — for example paying for calls, platform services, and receiving payouts from LekeeLekee programmes. By opening or using a Wallet you agree to the following:

• Not a bank account: LEKEELEKEE247 LTD is not a bank. Wallet balances are not bank deposits, do not earn interest, and are not protected by any deposit guarantee or insurance scheme (including the FSCS or NDIC). Payment processing is provided by regulated third-party payment providers
• Eligibility & verification: Wallets are available to personal accounts only. We may require identity verification ("KYC") before you can fund, transact, or withdraw, and we may impose transaction, balance, or withdrawal limits at any time to comply with applicable law
• Funding: You may fund your Wallet using the payment methods shown in the app. Funds appear after your payment provider confirms the transaction. You warrant that any funding source used belongs to you
• Security: Your Wallet is protected by a PIN and/or your account credentials. You are responsible for keeping these secret and for all transactions authorised with them. Notify us immediately at hello@lekeelekee.com if you suspect unauthorised access
• Withdrawals: Withdrawals are subject to verification, minimum amounts, processing times, and any fees displayed at the time of the request, and depend on the availability of our payment providers in your region
• Errors & reversals: We may reverse transactions made in error (including amounts credited to your Wallet by mistake) and correct balances accordingly
• Suspension: We may suspend, restrict, or close a Wallet where we reasonably suspect fraud, money laundering, sanctions exposure, chargeback abuse, or a breach of these Terms, or where required by law. Where lawful to do so, legitimate remaining balances will be returned to you
• Dormancy & closure: If your account is closed or terminated, we will make reasonable efforts to return any verified remaining balance to you, less any amounts you owe us, where permitted by law

11. Calling Services

The Services include voice and video calling between LekeeLekee users ("App Calls") and, where offered, calls to ordinary telephone numbers ("Phone Calls"). By using calling features you agree that:

• No emergency calling: LekeeLekee calling is NOT a replacement for a telephone line and does NOT support calls to emergency services (such as 999, 911, or 112). You must ensure you have alternative means of contacting emergency services
• Phone Call charges: Phone Calls are charged from your Wallet at the per-minute rates displayed in the app for the destination called. Billing starts when the call is answered (including by voicemail or an answering service) and is charged in per-minute increments. Rates may change at any time; the rate shown at the time of the call applies
• Insufficient balance: Calls may be blocked or terminated if your Wallet balance is insufficient to continue the call
• Data charges: App Calls use your internet connection; your mobile operator's data charges are your responsibility
• Quality: Calls are carried over the internet and third-party carrier networks. We do not guarantee availability, quality, or that any destination is reachable
• Lawful use: You must not use calling features for unsolicited marketing, robocalling, number spoofing, harassment, fraud, or any unlawful purpose, and you are responsible for complying with any laws that apply to your calls (including call-recording consent laws in your jurisdiction)

12. Advertiser Terms (Ad Manager)

If you use the LekeeLekee Ad Manager to create and run advertising campaigns, the following terms apply in addition to the rest of these Terms:

• Prepaid balance: Campaigns are funded from a prepaid advertising balance. Charges accrue against your balance based on the pricing model you select (for example per thousand impressions, per click, or per view) at your chosen bid, up to the budgets you set. If you enable automatic top-up, you authorise us to charge your saved payment method as configured until you disable it
• Review & rejection: All campaigns and creatives are subject to review. We may reject, pause, or remove any advertisement at any time, at our sole discretion, including for content that breaches our Acceptable Use Policy, applicable advertising regulations, or that we consider harmful to the platform or its users
• Your content: You warrant that you hold all rights, licences, and regulatory approvals necessary for your ad creatives, landing pages, and the products or services advertised, and that your ads comply with all applicable advertising laws and codes in the territories they target
• Placements: Ads may be served across LekeeLekee surfaces (including web, mobile apps, and widgets) and on partner and affiliated publisher properties, unless placement controls in the Ad Manager state otherwise
• Metrics & invalid traffic: Billing is based on our measurement systems. We filter invalid traffic where identified, but we do not guarantee any particular level of delivery, reach, clicks, conversions, or business outcome
• Refunds: Amounts already spent on delivered advertising are non-refundable. Unspent advertising balance may be refunded on request to the original payment method, subject to verification and our payment providers' rules
• Taxes: Stated prices exclude any applicable taxes, which are your responsibility

13. Rewards, Competitions & Promotions

We may operate reward programmes, competitions, prize draws, and other promotions from time to time (including the Creator Programme and Creator Rewards). Unless a promotion states otherwise, the following applies:

• Programme rules prevail: Each programme or competition may have its own published rules or terms (for example the Creator Terms). Those rules apply in addition to these Terms and prevail over them for that programme
• Eligibility: Programmes that pay money require you to be at least 18 years old, hold a verified account and Wallet in your own name, and meet the published eligibility criteria. Employees and contractors of LEKEELEKEE247 LTD and its affiliates may be excluded
• Calculations are final: Where rewards are calculated from platform activity (for example engagement-based scores shared from a reward pool), the calculation is performed by our systems as described in the applicable programme rules, and the result is final
• Fair play: Artificial engagement, use of fake or coordinated accounts, self-dealing, collusion, or any other manipulation is prohibited and results in disqualification, forfeiture of pending rewards, and may result in account termination and recovery of amounts already paid
• Discretionary & changeable: Pool sizes, prize values, criteria, and schedules may be changed, and any programme may be suspended or withdrawn, at any time. Participation does not create any employment, agency, or partnership relationship with us
• Taxes: Any tax due on rewards, winnings, or payouts is your sole responsibility
• Free entry: No purchase is necessary to participate in our promotions unless a promotion's own rules lawfully state otherwise. Where local law imposes requirements on prize competitions, the promotion is void where prohibited

14. Data Protection & Privacy

Our collection and use of personal data in connection with the Services is described in our Privacy Policy, which forms part of your agreement with us. In particular:

• We process personal data in accordance with the UK GDPR, the Data Protection Act 2018 and, where applicable to users in Nigeria, the Nigeria Data Protection Act 2023
• Using the Wallet may require identity verification, and we process the associated identity and transaction data to meet our legal obligations (including anti-money-laundering and fraud prevention)
• Using Calling Services generates call records (such as numbers dialled, duration, and charges) which we process to provide, bill, and secure the service
• You can exercise your data rights directly in the app — including downloading a copy of your data (Settings → Download your data) and deleting your account (Settings → Delete account) — or by contacting hello@lekeelekee.com

15. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LEKEELEKEE247 LTD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF CONTENT
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING ANY CONTENT OR INFORMATION POSTED BY USERS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Terms.

20. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising out of or relating to these Terms or the Services.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LEKEELEKEE247 LTD regarding the Services and supersede all prior agreements and understandings.
